Mom and I had quite the discussion about Nancy, during which I urged Mom to appoint a professional, UNBIASED trustee for the following reasons, to which Nancy has admitted "happened 10, 20, 30, 40+ years ago." :

In approximately 1980, I moved out into my own little apartment. I was happy and self-sufficient. Nancy decided she wanted some, too, and suggested we get an apartment together, to which I agreed. All went extremely well until the first round of bills arrived, which caused Nancy to balk, pack up her stuff, and move back home with Mom, WITHOUT PAYING HER SHARE OF ANY THING. Also resulted in me being left in an apartment I could no longer afford on my own.

In approximately 1990, Nancy would invite my little son to spend the night with her, Nick and Gary. Yet, when it was time to return him, or for me to retrieve him, I would find out hours later that Nancy had taken him to parts unknown. Astoria. Corvallis. Wherever. All without my permission or even a clue as to where they'd gone. I halted the overnight visits after trying to reason with Nancy many times. The next chance she got, the night of the Belle of Newport, she took him again, without permission or even notification.

In approximately 2000, Nancy set me up with her coworker, who caused the failure of my small independent home inspection business and the end of my HUD subsidy payments to Mom. It was UNCANNY how he knew which threads to pull. The end result was Moms "owing" Nancy free housing too, even though Nancy, herself, has been quite capable of working.

In approximately 2010, I was finally recovered sufficiently to begin planning another small business. Yet my startup funds had to be diverted to prevent Nancy effectively evicting me from the home Mom specifically willed to me. I KNEW Nancy would do this; it's why I urged Mom to appoint a professional, UNBIASED trustee - to which Nancy strenuously objected in this way on April 23, 2010:

When Mom died, Nancy began her threats to evict me from the home Mom clearly intended for me to own "at my (her) death," debt-free. She was in obvious denial about Nancy's attitude but Mom could still do the math.

Could this be why Nancy protested the idea of an independent, UNBIASED trustee? Could it be why she continues to ignore my officially disabled status in favor to trying to collect rent that I CANNOT PAY? Had she not set in motion her plan to trick me into giving up my HUD subsidy payments to Mom, that money would now be going to the Estate! Better yet, I might still be doing home inspections enough to have finally gained the ability to pay my own rent instead of becoming disabled and reliant on SSI income of $465 per month. I believe Nancy might, with her bullying and unneeded delays, might again be trying to trigger another suicide attempt on my part so that she can have Moms house to herself in peace. This is now known as "bullycide."

Nancy has forced herself into a position where she must inject money out of her own pocket to maintain her own interpretation of Moms trust in which she has used all the liquid assets to remodel Moms home (the main asset, which should have been placed on the market at least a year ago) to SATISFY HER OWN DESIRES. She is not the only one losing money due to implementing this impossible "authority to charge market value rent." I continue to lose $230 every month, while my home is on the verge of foreclosure due to Nancy's selfish misinterpretation of Mom's final instructions plus, it continues to fall into disrepair due to this ongoing loss of income.

So please visit Nancy Lynne Photography and give her your business! She needs the money to keep Moms trust going until Moms house is finally sold.

However, for these reasons and more, I cannot recommend that you vote her in for another term on the Toledo City Council or to hire her for any other position of real power or access to funds.

Admittedly, due to my PTSD, I did not present myself well in court. However, the facts remain:
By your actions (and by statements made by one in a position to know), I believe one might reasonably conclude that you may have been trying to implement a secret plan to eventually keep Mom's house for yourself, perhaps even at my expense. However, Moms house was NOT specifically willed to you. THEREFORE, you have NO claim to it. You DO, however, have a FIDUCIARY responsibility "to take every reasonable measure to make sure Brenda doesn't lose the (Seal Rock) property." I am here to cooperate to the best of my ability, as long as Mom's express instructions are followed.

As I have been saying ALL ALONG, had you chosen to distribute "at my (Moms) death" by immediately putting the Fogarty Street property on the market in January of 2011, you would have had enough cash IN MOM'S CHECKING ACCOUNT ALONE ($14,841 according to your first annual report) to keep up with the Marsh Street mortgage, to keep paying yourself an equivalent amount every month, and to cover incidental expenses while waiting for up to 10 months for Mom's house to sell, which should not have taken much more than 6 months. I have a very good friend who wrapped up a similar estate (house to be sold and all), in only 5 months.

By your own estimate, Mom's house (the main asset) was valued at $182,760. THEREFORE, subtracting the $63,833,71 left on the Marsh St. mortgage and an equivalent amount for yourself, there would STILL have been more than $55,000 remaining to pay the $20,447.65 equity loan balance, the $2,246.39 tax bill and other expenses. This minimal, simplified-for-discussion scenario does NOT consider the ADDITIONAL ASSETS mentioned in your first annual accounting.

$182,000+ Moms house value minus:
    11,000 Realtor fee
127,667 "In kind" distribution x 2
    20,447 Home equity loan balance
      2,246 Taxes due
     5,000 Trustees fee (2% by Oregon law = $3660 rounded up up to $5,000 for your extra trouble).

THEREFORE, the Trust's terms and intent would have been satisfied WITH a small remainder in cash AND:

NO out of pocket expense for you (Nancy).
NO growing expense for the estate's attorney (Jeffrey Pridgeon) which would not have been possible under this scenario.
NO accumulating personal damage or loss of $230 every month to me (Brenda).

NOTICE HOW everybody (BUT Jeff) would have benefited - just as Mom expressly stated. Judge Littlehales agrees, there is not enough value in the estate to justify additional attorney fees. If Mr. Pridgeon has REALLY been advising you to rent Mom's house instead of selling, WHO HAS BENEFITED FROM THAT ADVICE? Not YOU. Not ME. HIM!

An Open Letter to the Trustee, Nancy Lynne

Despite Tuesdays unfortunate ruling, THE FACT REMAINS that the trustee misinterprets one especially troubling and troublesome clause from Mom's trust document, depriving and even causing ongoing harm to both beneficiaries while enriching Mr. Pridgeon himself at our collective expense - proving that the only winners in such situations ARE the attorneys. We're smarter than this. Aren't we?

I do not know what fantasy world Mr. Pridgeon lives in, but my $465 income is NEVER going to translate to the ability to pay $600, $700, $800 in rent, even if Mom hadn't specifically instructed her trustee to do every thing within reason to make sure that "Brenda doesn't lose the property." Absolutely unrealistic and, perhaps, deliberately confusing?

At my meeting with him this coming Monday, I will be asking Mr Pridgeon to explain how that unfair (now thankfully obsolete) contingency text came to exist. I have emails showing that Mom could not explain the scheme in which I could be asked to pay nearly double my small monthly fixed income to rent the home she clearly meant for me, debt-free, so instead, she promised me (in an email and in her will and trust) that the arrangements she'd so carefully made (and not without considerable expense) would ensure that nobody would take my home from me. Nancy clearly didn't understand it either, made evident by her erroneous assumption of what does and does not constitute an actual will contest (among other things that most non-attorneys don't know).

So, Mom trusted Mr. Pridgeon to help ensure my housing needs were taken care of after her demise, with an equal share for Nancy, too, of course. Did Mr. Pridgeon misrepresent himself and pull a fast one on a dear old lady and her daughters for the sake of his own job security for "up to 10 years?" Though the trust expressly forbids it (the trustee is to do every thing within reason to make sure that "Brenda doesn't lose the property." Taken straight from the TRUST, ARTICLE 5), and this house is not in rentable condition anyway, but BECAUSE OF THAT CLAUSE and even the Judge's misinterpretation, I expect Nancy is probably working on serving a 72 hour notice as we speak. I hope not, but it wouldn't surprise me because ...

Not only IS/WAS there enough value to support Mom's first and foremost direction (to distribute at her death), there is clearly NOT enough to support Mr. Pridgeon's secondary contingency plan WHICH, not only has caused me monetary damages, it's caused the GED-level trustee herself to get the wrong idea which lead to a situation in which she found herself having to loan the trust her own money. We are not schooled in this stuff. Is Mr. Pridgeon taking unfair advantage of our collective ignorance and lifetime acrimony? Well he's a lawyer, isn't he?

Yes, I fired my attorney because, not only were my diverted biz startup funds exhausted, judging by Mr. Pridgeon's own response, I believed that the trust would finally be steered in the proper direction. I can see no need for an appraisal on my home because it is irrelevant to the trust. The amount this house might sell for is none of the Trusts business because the trust is forbidden to sell the house but, what IS the trusts business is the condition this house is in. Yet the trustee has apparently not been advised to obtain a home inspection to ascertain needed repairs to this trust property. Had that been accomplished, the trustee would have independent confirmation that her plan to rent out the Marsh Street house, in addition to being against the terms of the trust, is unrealistic mathematically as well.

I personally am losing $230 every month that could/should go to repairs to my inherited home, which the trust and trustee cannot afford to fix without breaching the trust by taking possession *from me.* In Catch 22 style, many thousands in repairs would need to be completed before this house could be actually rented, an expense the trust cannot bear. Again, completely unrealistic! Every day this mess is dragged out is another day for the Marsh Street property to fall further into disrepair, which benefits nobody except Mr. Pridgeon.

The condition of the real estate market is also irrelevant - though there MIGHT be more value later doesn't matter. THE CURRENT VALUE IS ADEQUATE TO SUPPORT MOM'S WISHES THAT EQUAL SHARES BE DISTRIBUTED AT HER DEATH. Plus, the market could easily decline which would be detrimental to the trust (which, lest we forget, exists by it's very nature to give advantage to all beneficiaries).

Simply put, Mom left me this house, debt-free if possible, with an equal amount for Nancy, too, and there IS enough value to implement that plan now (there might not be later). I AM DONE going along with being exploited. However, the millisecond that the trust begins being handled the way in which Mom expressly specified, I promise, I will become the very model of cooperation. Enthusiasm, even!

I believe I might just have found the thing that could draw my sister and me back together: the asinine clause created by Mr. Pridgeon has been detrimental to BOTH of us, not to mention Mom. Exactly right, there isn't enough to fight over, so why am I being criticized for representing myself? OTOH, this is my only home, mine by inheritance but at risk because of inappropriate trust language. Of course I'm going to fight for it. There would likely never have been an issue had Mr. Pridgeon been paying attention to REALITY when he created the trust for Mom.

So, yes. I am going to suggest to my sister, Nancy Lynne, that she, too, consider the harm that Mr. Pridgeon's fiction-based clause has caused the BOTH of US.

Reality-based trust language would have saved Mom, Nancy and me some very contentious and expensive trouble. I once made a report to the California Bar Association which resulted in a full refund of my retainer PLUS $1000 to compensate for damages. I believe I am up to this task, especially since this situation AGAIN interferes with my plan to get back to work. For this reason, I continue to have time on my hands and, as a named beneficiary, I have legal standing to make a complaint on my own, but I invite Nancy Lynne to join me in recognizing the damages Mr. Pridgeon's creative writing has caused ALL 3 OF US.

Nancy wants me to work with her. Hell yes. Let us finally get on the same page and be done with this unpleasantness for good! Let us be too smart to let the blood-sucking attorney be the only winner. Thanks in advance for your thoughtful consideration, Nancy. :o)

I guess it's clear now that I would not recommend Jeff Pridgeon when considering your estate needs. I have 2 legal aid agencies on speed dial in case of an erroneous eviction notice based on Mr. Pridgeon's mathematically faulty contingency phrasing. Have a nice day!

If there is any "trap" involved, it is the one you have unwittingly set for yourself by forcing your way into this position of authority without the first clue or care as to the legalities and responsibilities involved.
If you "have to" loan the trust money, it's ONLY because you have taken it in the wrong direction. A natural consequence of your own mistake.
For the second year and despite being made aware of the law, you have provided no supporting source documents. What are you hiding?
According to independent analysis, the trust does/did have sufficient value. The assets aren't "liquid" because you have steadfastly refused to comply with the terms of the trust and and distribute "at my (Mom's) death." Fixer uppers are sold all the time, and the unique zoning would likely have made up for the poor condition.
If it's true that the main asset will become unrentable in the event you finally concede to put it up for sale, then this unfortunate situation, again, is a direct a result of your wrongful decision not to put it on the market in the first place.
I have a witness now who confirms that your intent has long been to keep Mom's house for yourself. Your current behavior does nothing to discredit his statement. Perhaps this is why you were so excited to spend money that didn't exist to fix it up the way you like?
Slander and defamation = lies. Posting your own words for the benefit of your constituents does not qualify, Councilor!
I will NEVER go along with your corrupt plan to collect nearly twice my monthly income for the house that Mom clearly wanted me to have, debt-free if possible. And it is possible. AS THE TRUSTEE, YOU are legally on the hook for all losses to the trust. Read the law! And re-read the trust. That clause you cling to and rely upon so heavily to suit yourself is clearly an OBSOLETE CONTINGENCY PLAN.
The "homeowner" is responsible for paying the water bill. SRW will confirm this. Besides, you did pay it before as an excuse to pay yourself an equivalent amount. I requested you cease in hopes that you had good and proper intent to sell Mom's house after it was fixed up. However, that was not the case and now, your traitorous conduct deprives me of income each and every month.
Clearly, you are not Mom. Nor are you acting on her behalf or in her best interests, but obviously your own - it has ever been thus, and THIS is why I begged her to appoint an honest, unbiased Trustee, resulting in the No Contest clause which you also erroneously interpreted. What might you have said to Mom to get her to add that clause for your own perceived benefit? After all you've said to me to get your own way, I can only imagine. The thought that you were able to drive me away makes me cringe for her.
You've collected an equivalent amount to my rent-free housing over the years, exploiting Mom's inability to think or stand up for herself (or me) as well as my disability - to which your own behavior has contributed in a big way, yet you yourself are not disabled. And you insist that *I* am the one who's milked the trust dry?
Why is your equal share never enough for you? Things would be going a lot smoother for you had you the slightest regard for Mom's true wishes and/or the law. This mess is of your own making and in the end, AS THE FIDUCIARY, you WILL be held accountable. I've tried to help you by showing you the law, but you have steadfastly refused to listen. I can do no more.
If, as you say, Jeff Pridgeon is advising you to stay this erroneous course, he's opening himself to disciplinary action by the Oregon State Bar. I find this highly doubtful about an attorney whose reputation allowed him to serve Pro Tem in Judge Littlehales' absence and even if it were true, the buck still stops with YOU, "Trustee."
You have abused your position (after having manipulated your way into it), to take (again), $500 that you've owed me for 30+ years. You admitted to your actions, just not your responsibility for them. See also, child abduction, sabotage by sweetheart scam, etc. etc. etc. You are wholly and totally unfit for this position in temperament, lack of education, etc. etc. etc.
ONCE AGAIN, you are now a FIDUCIARY, entrusted to enact Mom's final wishes with THE UTMOST in good faith and honesty. No more, no less. If she had wanted you, alone, to have her house, I'm sure she would have expressed that wish. Unfortunately for you, she did not. To use your own favorite phrase, GET OVER IT.

FAQ: What finally triggered the onset of my C-PTSD? After 5 years of building it, I was just starting to really get going with my home inspection business when I was set up with a guy who worked with Nancy at Gold Motors. It was UNCANNY how he knew just which threads to pull to unravel my life. I paid dearly for this mistake.

Within 6 months, I went from AAA credit to BK. $300K loss, not to mention the business and its income. In addition to being given a "finders fee" of sorts (right in front of me, heaven only knows how much more she got behind my back) for her role in setting up this "union," Nancy, too, began receiving a monthly check to cover HER house payments, even though she, herself, is not disabled. THIS was the last straw.

13 years later, I began feeling like I could finally, again, make a contribution society with the goat grazing biz but nooooooo. I was forced to divert my startup funds to fight Nancy wrongfully evicting from the home Mom clearly wanted me to have, debt-free if possible. There were enough assets to make Mom's wishes possible, but Nancy doesn't honor Mom now any more than she ever did. How depressing.

So here we have a city councilor actively thwarting 2 businesses to benefit only her greedy self.

Nancy Lynne's second annual trustee's report is due by the end of this month at the latest. I don't have any reason to believe she's seen the light and accepted the loyalty and impartiality required by the fiduciary duties she bullied her way into. Considering her blatant lack of respect for Mom's final wishes, I believe it's reasonable to presume that she had the same attitude prior to Mom's death. Therefore, I will more than likely be adding her next report to the previous one, along with a nice fat stack of email evidence and a copy of all Mom's evolving wills to this letter to the Lincoln County District Attorney.

RE: Financial Abuse of Disabled Person

Dear Mr. Bovett:
I'm writing you regarding a troubling situation to which I believe ORS 124.110 applies. To summarize:

I am the beneficiary of a trust, created by my mother, Jan Eddleman. My sister, Nancy Lynne, also a beneficiary, is the current trustee.

I am on disability and currently recieving $465/mo. SSI with a diagnosis of chronic depression rooted in PTSD.

My sister, the trustee, is wrongfully withholding my inheritance (which consists mainly of my only home) and even threatening to sell it.

Upon first reading Mom's most recent will (which, this time, included a trust), I came across language that my sister, the trustee (with whom I have been estranged for many years), I rightlfully suspected, would "cherry pick" and misuse to avoid making a timely distribution (see TRUST DOCUMENT, Article 5.1). Therefore, I urged my mother to appoint a more honest, impartial trustee. She declined my request with the promise that

"nobody is going to take the house away from you," (see EMAIL, May 15,2010).

In addition, I received an email from my sister stating the following:

"... If you're trying to get Mom to change her will, I will say that I don't think this venomous spewing of hatred towards me is going to accomplish that. In fact, I suspect it could have the opposite effect. You're walking a very fine line." (see EMAIL, April 23, 2010).

On November 2, 2010, Mom passed. In February, 2011, I recieved a copy of the trustee's first accounting and report (see enclosed) which, instead of explaining how the trust would be distributed according to Mom's express wishes, stated that she, the trustee, would be (taking the trust language out of context and) charging me for (or evicting me and selling) the home Mom clearly stated that I should have, debt-free (if there were assets to cover such a distribution with an equal share for my sister/trustee/co-beneficiary, which appears to be the case - see RECENTLY SOLD COMPARABLE HOMES).

Judging by the "comps," valued at $150,000 to $225, 000, had Mom's previous residence been sold at her death as she directed, the proceeds would very likely have enabled the trustee Nancy Lynne to make distribution as instructed: to pay off the >$65,000 mortgage on the home Mom clearly wanted me to have with an equal amount left for herself.

From Mom's Trust document, Article 5.1:

"DESCENDANTS. At my death, my trustee shall distribute the residue of the trust estate in equal shares to my children. ... I direct my trustee that the share of Brenda Haines shall ... include my real property in Seal Rock in kind ... to take all reasonable measures that facilitate this distribution in kind."

Instead, however, citing my historical lack of respect for her (my sister, now the trustee) as cause, Nancy Lynne has steadfastly refused to comply with the direction and purpose of the trust document (see email).

"My 'sense of loyalty' is perfectly intact for people who actually deserve it. I do not now, nor have I EVER owed you any kind of loyalty. This little outburst from you makes it crystal clear that you have despised me from the day I was born, simply because you had to share Mom's and Dad's attention. How sad and pathetic. If you had treated me with anything resembling respect, things would be entirely different. Your actions are coming back to bite you and it is all your own doing. If I do not receive your cashier's check in my mailbox on the 20th, you will be contacted by a Realtor and a sign will go up in front of that house."

I believe this wrongful withholding of my home/inheritance constitutes a violation of ORS 124.100, the description of which is as follows:

"When a person wrongfully takes or appropriates money or property of a vulnerable person, without regard to whether the person taking or appropriating the money or property has a fiduciary relationship with the vulnerable person.

(b) When a vulnerable person requests that another person transfer to the vulnerable person any money or property that the other person holds or controls and that belongs to or is held in express trust, constructive trust or resulting trust for the vulnerable person, and the other person, without good cause, either continues to hold the money or property or fails to take reasonable steps to make the money or property readily available to the vulnerable person when:

(A) The ownership or control of the money or property was acquired in whole or in part by the other person or someone acting in concert with the other person from the vulnerable person; and

(B) The other person acts in bad faith, or knew or should have known of the right of the vulnerable person to have the money or property transferred as requested or otherwise made available to the vulnerable person.

ORS 124.125 states: ... any district attorney may bring an action against any person who engages in conduct described in ORS 124.105 (Physical abuse subject to action) and 124.110 (Financial abuse subject to action)."

I believe that a close inspection would indicate at least a presumption that Nancy Lynne, in order to gain control and keep my rightful inheritance from me, (perhaps hoping that it would cause me to attempt suicide again), used tactics known as "undue influence" to separate Mom and me and to convince our elderly, alcoholic mother that I am bi-polar and/or schizophrenic (untrue) and therefore, unable to handle my own affairs - and that she, Nancy, would comply with Mom's wishes for my benefit as indicated by her message of April 23, 2010 (see email).

"And for the record, I do not want your house. I want you to own it free and clear, just like Mom does. Just like she has stipulated in her will."

Unfortunately I can prove none of that. However, there can be no doubt that the trustee continues to insist on wrongfully appropriating the assets entrusted to her by our addled, terminally ill mother. I was planning to start a small business last year, but I was forced to divert my startup funds to stave off a wrongful eviction. Due to my meager income, I can't afford another lawyer, so I've been trying to represent myself in a lawsuit against the trustee, to no avail (see enclosed motion to dismiss). I'm in over my head there.

My home/inheritance/well being remains wrongfully at risk as long as the trustee Nancy Lynne is allowed to continue with her abusive and secretive conduct. A good friend of mine served as an executor and had her task wrapped up, including a house sold, in only 5 months time. Considering that, had it been handled correctly, there's a good chance that this matter could have concluded by mid-2011.

Instead, in addition to the stress caused by the wrongful threat to my home, and the harm caused to the trust itself by Nancy Lynne's errors, I am losing approximately 1/3 of my potential SSI income, an increase of approximately $233/mo. specifically meant to help with the expense of home repairs and upkeep -- and my home has developed some structural/safety problems (unsafe decks and electrical issues among other things) which are also being neglected by the trustee. To date, my personal loss is approximately $1816.

This situation does nothing to alleviate my PTSD-related depression. I have exhausted all other known resources and so, as a last resort, I have little choice but to prevail upon your office for help before the situation gets further out of control.

I am enclosing copies of the trust document and relavent correspondence. Please don't hesitate to contact me for more information, and thanks in advance for your prompt and helpful attention to this distressing matter. I am grateful in the extreme for any assistance your office can provide. Please, please, please, I need your help!

The Kingdom of Narcissism
I guess it is poetic justice to post this article on April 1st, aka, April Fool's Day.

This is dedicated to all of us who have suffered & those who are still suffering at the hands of the Counterfeits in the Kingdom of Narcissism also known as the KoN.

This has been my life up to this point, so it is a bit of a read. It is a life-time of experience condensed into one article, or more accurately speaking, one chapter. I am not a writer, just someone who has spent the first part of her life in The KoN. Grab your favorite drink & snack and I hope you will enjoy the read!

I never felt comfortable with calling my biological mom, mom. Nobody is perfect, I get that, and she was never a Mom in any small sense of the word. A Mom is someone who loves and protects their Children and that is something she never did. Just like a Spouse is suppose to love, cherish, and protect and how a Friend is suppose to love you by having your Best Interest at Heart. A Counterfeit is something or someone who looks like and imitates the Real Thing, but is nothing less than a Deceiver and a Fraud, hence I have a New Title for my egg donor, Counterfeit Mom. Same thing for the sperm donor who appeared, disappeared, and reappeared in our lives when ever he needed a Narcissistic Fix and play Super Dad, along with the fact that he preyed on his own children makes him, the Counterfeit Dad. And the spouse that abuses is a Counterfeit Spouse and the friend, co-worker, family member or sibling that betrays is the Counterfeit Friend/Co-worker/Family Member/Sibling.

The Kingdom of Narcissism, aka (The KoN), comes from the fact that Narcissists don't live in the real world, but their own. They have their own reality that everyone living in the KoN must accept or they will be deemed crazy. A land in which the Narcissists (Ns) are all powerful and rule over the Less-Thans (us). A land in which they make the rules and break the rules. A land in which everyone must act just like them & think just like them. A land of no mirrors that will reveal their True Identity. A land of guilt & accountability for everyone else, but them. A Land where the Narcissist's sins are forgivable & accepted and you must be perfect. A Land where Mercy & Grace must be given to the Narcissist, but none is given to you. A land where abuse is how they show love. A land where verbal abuse is accepted and encouraged because is makes you strong to face the world. A land of GasLighting, Triangulation, and Manipulation. A land where ground is made out of egg shells & everyone tip-toes around trying to keep the Great Counterfeit happy, so that his/her True Nature/Identity, the Narcissistic Vampire will not come out and attack. A land that is actually a landfill containing Hidden Bombs and no one knows how or when they will explode, but we know Who shows up when they explode, the Narcissistic Vampire. A land of make believing everything is fine. A land of secrets. A land of lies. A land where Truth is relative and what you make it. A land where relationships are held together through Fear, Guilt & Obligation, aka the FOG. A land of Group Sabotage & Self-Sabotage is encouraged, so that no one can do better than the Narcissist. A land of Dead Dreams. A land where your Self-Esteem & Self-Worth is slaughtered as a Child and when you are an Adult with no Self-Esteem you are kicked in the face for not having any. A land where your Family is your Foe, but you don't know, until you leave. A land where love does not exist.

Now that my Counterfeit Mom has been exposed for the truly toxic unremorseful evil Narcissistic Vampire she really is, I look back at her behavior in recent years as well as the distant past (some of which I shared in this blog) and wonder, How could I have been such a Fool not to see her for who she really is? I guess that is what constant and consistent years of denial will do to a person-it numbs you to the truth. It is a sad heartbreaking situation when abusive evil toxic behavior becomes your "normal standard" in the KoN. Well, here's to being a Fool no more! Once the last scales of denial fall from your eyes the truth will be too painful to ignore and the truth shall make you free!

Yes, it is a Tale as Old as Time, from the Evil Serpent in the Garden pretending to be something he is not in order to deceive the first Woman & Man to the famous classic story of Dr. Jeckyll and Mr Hyde, or in modern terminology, to the real life situations of Great Counterfeits and their hidden secret identities. . . Narcissistic Vampires.

Toxic, Abusive, Narcissistic, Family or Friends are nothing more than Great Counterfeits. To outsiders who are unexperienced with manipulative narcissistic behavior these Counterfeits look like the Real Thing. The Main Reason is that Narcissists spend the majority of their time with Self-Promoting their False Image of a loving, caring, and supporting person. That is until someone courageously holds a mirror up to them, and like all Vampires, the Loving Reflection is missing. The Narcissistic Person quickly goes on defense by claiming the mirror must be broken. Only the very wise & experienced can detect this excuse for the lie that it really is while others, despite what they see with their own eyes, will agree that the mirror must be broken.

This is analogous to the famous children's story, The Emperor's New Clothes where two great Deceivers/Counterfeits convince the Emperor and all the people in his kingdom that "only the wisest of people will be able to see the Emperor's new outfit" which like all lies is nothing but thin air. The Emperor parades down the Main Street naked as the day he was born all while people are denying what they are witnessing with their own eyes and instead declaring how beautiful The Emperor's clothes are even though he is not wearing anything at all. The fear of being singled out, ridiculed, alienated, alstrasized, and rejected by others is so great that people will conform to a lie no matter how ridiculous it is. It took a child to boldly speak the Truth, The Emperor has no clothes on! to expose the popular accepted Lie. Everyone could obviously see that the Emperor had no clothes on, so Why didn't they speak up? Was it just the power of Crowd Conformity that kept them quite, or is there something more?

Not only did people not speak up for the Truth and remain quite, but they actually lied about how great the Emperor's new clothes looked on him. What was that all about? Was it just a lack of integrity on their part, or was it a selfish act of self-promoting? Were these people positioning themselves to be the Golden Child. The old saying goes, Evil exist because good men do nothing. If evil exists because we do nothing, what happens when people actually do something to support a lie, like with the Emperor's new clothes where people were piling lie on top of lie w/compliment after compliment about clothes that didn't even exist. Piling lie on top of lie buries & covers the Truth up completely that the crowd/family actually starts believing their popularly accepted lies. It takes a set of new fresh eyes that has no ties to the crowd/family or the Emperor/Great Counterfeit to uncover the Hidden Truth and expose the statements/perceptions/attitudes/behaviors/feelings for what they are, False and nothing more than made up Lies.

When the loving image/behavior of the Great Counterfeit is missing there are only two basic reasons. The first is that, as stated before, the mirror must be broken. There must be something wrong with your eyes (the Broken Mirror) that you can not see an image that is not really there (i.e., Naked Emperor w/invisible clothes that don't really exist)--not true! You must have just imagined, dreamt up, or hallucinated the entire Harmful Event--not true! You are just not "recalling things correctly"--not true, you did! You are just "too sensitive"--not true! To Narcissistic Vampires who have no heart/emotions, due to their lack of Empathy, you actually having a caring heart/emotions make you appear to them as "too sensitive". It is not your defect, but theirs for being numb, calleoused & cold hearted. The assumption is there must be something wrong with you, because others are willing to accept a lie despite what they see with their own eyes. In other words, let's ignore all the timese the NVampire is abusive and just focus on the good things s/he has done for you & others. The mean abusive toxic behavior doesn't truly reflect who the Great Counterfeit really is because (insert accepted excuse/lie here, "had a bad day" "didn't really mean it" "stressed out" "lost control" "didn't know what s/he was doing/saying" "not themselves" etc.).

The Alternative Reason, the Truth, is to realize that the kind, caring, positive image of the Great Counterfeit is just a Deceptive Illusion and False, Evil is as Evil does, and accept there is an evil Narcissistic Vampire in our family, which for the majority is way too frightening for others to face. The second evil trick the Narcissistic Vampire does is to Divide and Conquer. Their Primary Target is the person who held up the mirror. These Evil Vampires turn into the Great Counterfeits turning on their charm and meeting the needs & desires (emotional &/or financial) in the family population to create an Illusion that is in direct contrast to the one in the mirror -- thus the mirror, or better yet the person holding up the mirror is broken.

The family population one by one start to second guess what they saw with their own eyes because surely The Great Counterfeit who has been there for them can not be this mean, thoughtless, heartless, evil person that has been reflected back to them. They suffer from a form of Cognitive Dissonance when their mind is forced to consider two conflicting pieces of information. (1) The Counterfeit is kind to them doing nice things for them, or at least not abusing them, so they think the Counterfeit must be a good person (2) the Counterfeit is abusing a loved one (us), so the Counterfeit must be a bad person. Which is it? Is the Counterfeit Good or Bad? It is the Enablers own internal Nism that keeps them connected to the Counterfeit. They think to themselves, if the Counterfeit is good to me, then s/he must be a good person (or at least partly good) and not toxic, pathological, or as bad as we say the Counterfeit is. Those who are not attacked think, since my perception is correct (the Counterfeit is a Good Person), yours must be wrong, thus you are the broken mirror, you are the problem and not the Counterfeit. There must be something wrong w/you that you don't see the Counterfeit the way I do. They will deny the Truth and replace it for excuses/lies and even have Selective Amnesia and rewrite history, so that they can not recall the abuse, or at least not to the extent that we do.
The Enablers are questioning and denying reality, which is a form of Gaslighting which makes you feel like you are confused & crazy for accurately remembering the situation moment by painful moment . Counterfeits are also very manipulative and use favoritism to confuse people, they are known to treat family members very different, thus creating very different perceptions of the Counterfeit's true identity. Once again the Enabler's own Nism kicks in and they blame the victim for the abuse s/he is enduring, that some how we are responsible or to blame on some level for the Differential Treatment from the Counterfeit. Enablers are usually not conscious of their Victim Blaming attitude (or they don't want to be) and will immediately deny it if you ever confront them with the possibility of it. The Counterfeits also play into the Enablers Nism by completing them at the same time devaluing us, "you are the kindest of all my children, most loving, you are the easiest to talk to, I wish your Sibs could accept me like you do, You are not judgmental (implying that we are), you are so forgiving (implying that we are not), you are such a Loving, Kind, and Good Person (implying that we are not) followed by a direct slam of the Target (us), thus bringing the Enabler to the Counterfeit's side, creating a separation between us and the Enabler and completing the Divide and Conquer".

The goal of the Counterfeit is for the Enablers to identify w/the Counterfeit against us. It is such a joke that the Momster actually thinks she is giving us a compliment when she says, "Don't tell the others, but out of my 3 children you are the one that is most like me." YIKES! The last time she told me this, I said I felt the Momster was more like the Med. level Nsis and that was before I had realized that Sis was a N -- looking back I guess I saw their connection to Nism and it explains why I always felt like A Stranger in a Strange Land. Never felt at home in my own home. More like an unwanted guest in someone else's home. Counterfeits do not like it when family members are getting along and there is peace for too long, because then we start to compare notes, the Counterfeit's cover is blown and their lies are exposed, so they constantly try to create chaos and conflict between & among family members. Get the puppets fighting among themselves, so they don't realize who is pulling our strings. When we hold the Counterfeit accountable for his/her abusive behavior people in the KoN have two ways of handling abuse, they either deny it by saying it didn't happen or justify it by Victim Blaming to one degree or another. Deniability resolves them of accountability. I use to think that the Momster just had a different reality than mine, but she has the same reality, she is just a liar, so that she has no responsibility for her actions. Counterfeits will tell you any lie you are willing to believe that will exonerate them of responsibility. The Momster knows that what she did and said was wrong and hurtful, but she just doesn't care and last year she finally admitted her true feelings or lack there of for me and any other Person in her KoN. This even shocked the Nsibs who are enabling her and tried giving her numerous chances to recount & regret what she said, but instead she said, "this is how I feel. I truly feel this way. I really do." I thought that this would wake them up to reality and it would if they were Normal, but they are not. They are also Ns and part of them identifies w/her instead of being repulsed by her. I did not understand that until I realized that they are Not Normal and are Ns, and now it makes sense that they will most likely never be repulsed by her because they identify with her. They get disappointed, but not appauled, repulsed, or disgusted. They will always enable her Nism because on some level it makes sense to them, the Nism is normal & acceptable and their pathology is what they have in common and keeps them connected to one another and is what kept me from relating to them & truly connecting w/them. It is really coming together for me right now at this very moment as I am typing this sentence.

An entire new level or layer of understanding in regards to the Narcissistic Family of Origin (NFOO). It is my Nsib's lower level of pathology that not only clouds, but completely destroys their judgement and perception of reality and what is normal & acceptable behavior and what is not. Nism is acceptable behavior to them, even though they can state that it is wrong, it is still acceptable because they can relate to it. Enablers never hold the Counterfeits/Abusers truly accountable, because they don't require the Abuser to change. They say they want the Counterfeits to change, but they never require them to change and instead make excuses for why the Counterfeit is not changing, thus enabling the abusive behavior to continue. And the Abusers/Counterfeits hold the Enablers in such high regard, because the Enablers don't require them to change and "they just accept me for who I am". The Counterfeit feeds into the Enablers own Nism by stating how much better they are than us because of their "accepting others as they are & don't judge them & require them to change"-- this was huge for the Momster & she made this statement any time I held her accountable for her hurtful behavior. She deflected her own responsibility for her hurtful behavior by saying that I am unforgiving, judgmental, not a good person & not a good Christian. She manipulates all involved and puts the focus on the Victim who identifies the abuse, instead of the Abuser who causes the abuse. Enablers accept (continue to have a relationship with) the Abuser/N because they accept Nism. Or is it the other way around? The Enablers accept the Nism, because they accept the Abuser/N (they identify w/the Super-Sized N because they are a lower level N). Birds of a N-feather, flock together.

The GasLighting Conformity among the Counterfeit and his/her Enablers and their Target (us) is so powerful that it can make you second guess yourself which creates an internal dilemma, you must either stand alone in the Truth and suffer the impending consequences of being the Counterfeit's Primary Target along with the alienation & substandard deferential treatment from the family (i.e., becoming the proverbial black sheep of the family), or join the denying, enabling cowards in the crowd/family. Yes, it is true, I have very little sympathy for Adult Enablers (see article, Enablers are Secondary Abusers). When you reach your own Proverbial Last Straw (see article w/the same name), a truth that is too painful to ignore, you will have the strength to resist the wave of Conformity & Denial. This is when you will take your first baby steps in leaving the KoN. Thus, the retaliation of isolation & alienation of the one holding the mirror, you, the primary Target, Enemy #1, begins. This is referred as the infamous Smear Campaign.

During the Smear Campaign, those who have left the Kingdom of Narcissism (KON) are accused of being self-righteous, judgmental, and having unrealistic expectations of others. My Nsibs stated that I have too high standards for the Momster. Well that is their viewpoint that keeps them enmeshed in the KON. Is it that my viewpoint was too high or their was too low? A message I had to say to myself over and over again was, It is not my job to explain the obvious. Other people who know just a little bit about the Momster's history totally get why I need and want to leave the KON. Those that remain in it just don't get it and never will, unless they experience a Truth Too Painful To Ignore -- unless the knife from the N is sharp enough and goes deep enough to wake them up from their Delusion.

Misery loves and needs company. Enablers need you to keep the Lie alive, by you leaving you causes them to look at their own life and they don't like what they see, so instead of doing the hard work and fixing it they blame you. According to the people living in the KoN you are a Broken Mirror that needs to be fixed not them. The primary/direct abuse from the Counterfeit, aka, Narcissistic Vampire is horrible enough by itself, but now your own family members will turn against you for just speaking the Truth. It makes no sense that you would be attacked for warning family & friends about danger, but then again nothing in the KoN ever makes sense where your family is your foe. Many of us are & have been tempted to put down the mirror, so as not to be alstrasized from the family. Yes, the Great Counterfeit/Narcissistic Vampire has won the first battle, but like all true evil people they are destined to lose the final war.

The Great Counterfeits begin their Smear Campaign, or better yet has their least favorite Golden Child do it for them, by trashing you in the eyes of other family members & friends. They strategically select their least favorite Golden Child because if the truth ever came out that the Great Counterfeit was behind it all s/he could use the least favorite as the scape goat/sacrificial lamb and deny the allegations completely by placing full blame on the least favorite Golden Child. If the Great Counterfeit is in jeopardy of exposing his/her true identity, Narcissistic Vampire, s/he will risk losing the relationship of the least Golden Child to cover up the Great Counterfeit's hidden agenda which is ultimately to protect his/her true identity, the Narcissistic Vampire. Remember people have no real value to Narcissistic Vampires other than to be used to support their evil agendas. People are replaceable. To the Great Counterfeits/Narcissistic Vampires loosing one of their enabling supporters is just a causality of war. The Great Counterfeits/Narcissistic Vampires think so highly of themselves that they can manipulate, persuade, and convince the least favorite Golden Child, the person that they just used to do the Counterfeit's dirty work, that "it was just one big misunderstanding."

There is a reason for The Great Counterfeits/Narcissistic Vampires extreme confidence in their devious persuasive ability--it works! And each time it works The Great Counterfeits/Narcissistic Vampires get that more confident, because their false Illusions get that much stronger. The Illusion becomes so strong over the years that people can not see through it. It becomes almost unbreakable. The sad truth is that some people can not or will not see through this seemingly unpenetrable illusion that they never leave the KoN. The only thing I can think of that is worse than looking back realizing how many years you wasted in the KoN is being the last remaining Enabler. After the Great Counterfeit/Narcissistic Vampire has died and gone to Hell, the remaining enabling spouse is left in the KoN all alone wondering where everyone went? Why am I all alone? Don't fall for that trick! Let them reap what they sowed. The thing that is worse than spending so many wasted years in the KoN is dying in the KoN. The truth will eventually come out and even though our enabling family & friends refused to accept the truth about the Great Counterfeit/Narcissistic Vampire while they were here on Earth they will have to deal with it for eternity. Being a Fool for Eternity trumps being a Fool for a few years, or even a few decades here on Earth!

For those of us who refuse to deny the Truth of what we have seen & experienced with are own eyes, How do we fight this Great Counterfeit who has convinced everyone that s/he is not an evil Narcissistic Vampire? The best way to fight them and reveal their true identity to others is to call their bluff. The Great Counterfeits are counting/depending/relying on our Fear of Alienation from the family. As long as we continue as "things as normal" and "be the better person" and stay in the KoN we provide the Great Counterfeit a personal target. As long as we are present the Great Counterfeit can claim, "see I'm not the mean, toxic, abusive, bad person who she says I am because. . . "
(I am still married to her, we have contact with one another, she sent me this great Mother's/Father's Day Card, I attended her birthday, wedding, or any other important family event where the Great Counterfeit can suck their narcissistic supply from all of this supports the Counterfeits Illusion of being a Good Person). In other words, If the Counterfeits/Narcissistic Vampire are so bad, then why are we still in contact with them? Why do we interact with them? Why do we have a relationship w/someone that is suppose to be so terrible? If they are so horrible, why are they still involved in our lives? Counterfeits have a great ability to call us out on our humanity and use it against us at the same time. We become a walking contradiction & dare I say a hypocrite in the eyes of others, not to mention creating internal conflict for ourselves by implementing self-doubt. We must own up to our own past enabling behavior in regards to the Counterfeit. There is no shame in admitting that we were once N-chanted by the Counterfeit's elaborate Illusion like the rest of the family. We were deceived before, but now that we know the Counterfeit's true identity we must accept reality. By accepting Reality and the Truth about the Counterfeit, we then must make some very hard decisions about not having any more contact with the Counterfeit. It doesn't mean that you have to end contact w/the Enablers. Depending upon whether or not the Enablers are Normal People or lover level Ns you leaving the KoN can have a Life Changing Effect on them. The Counterfeit must be "that Bad" if you are leaving the KoN and ending your relationship with the Counterfeit until s/he has received Professional Help, is completely accountable for the pain s/he has caused you and has Truly Changed. If the Counterfeit is a high level N, then True Change is not possible, and lower level Ns can only manage their Narcisstisic Tendencies. Once that mask of the Counterfeit has been removed so has the deception, where the only thing left now is Truth or Denial. Enablers choose Denial and that is why they can continue to live in the Counterfeit's KoN.

When Counterfeits use us as their personal target practice in front of others it turns other family members & friends into cowering enablers who's self-protection counteracts & overpowers their need to protect the abused family member/friend. They think to themselves, if I stand up for the Truth, for the one holding up the mirror, then I too will suffer the same attacks. If these Enablers are in any way dependent on the Great Counterfeit either now, or for the future, they will remain silent. The Counterfeits know the Enablers weakness and can buy the Enabler's loyality through one way or another. The Enabler might privately come to you offering sympathy for the "harsh treatment" the Counterfeit has done to you, but they rarely side with you against the Counterfeit, especially out in public where there are other witnesses, and they will not go directly to the Counterfeit on your behalf, and it is extremely rare that they will go with you & support you while you confront the Counterfeit. When they go as support it usually back fires against you, because they down play the Counterfeit's attacks & hurtful behavior. Where the Counterfeit is concerned, Enablers are all talk and no action. The only way to expose the Great Counterfeit for the Narcissistic Vampire s/he truly is will be to refuse to be a target and go totally No Contact (NC). By going NC you first and foremost protect you & your own family from abuse, and secondly remove the personal target, so the Narcissistic Vampire must find a new target to get his/her narcissistic supply from.

If the Great Counterfeit is your supervisor and you have gone to HR (human resources), or whatever your company's policies are to resolve "issues" and nothing has been resolved, regardless of all the very detailed documented incidents of attacks of sabotage (date, time, place what happened) you presented that will ultimately harm the Company's Moral and Productivity, not to mention make them Libel for allowing a Hostile Environment to continue, and the Great Counterfeit/Narcissistic Vampire still continues his/her attacks, and you repeatedly go back to inform HR that the attacks of sabotage has not stopped, and once again nothing changes, then your last effort is to inform them that if they don't take appropriate actions, get rid of the Great Counterfeit, then you have a couple of choices. First to seek Legal Actions against all involved who are allowing a very hostile work environment to continue. Be prepared for the fight of your life. You must have your documents in order, names/titles, dates, times, witness, everything you can think of to build & prove your case. Prepare for the Company to side with the Great Counterfeit, transfer you to another department, or fire you or "down size" and your position is eliminated due to "budget cuts". If you are open to a transfer to another department/branch/store, then you might make that suggestion to HR during your First report of attacks from the Great Counterfeit. As long as the Great Counterfeit has direct or even indirect control over your position your job is in jeopardy. Even though the Counterfeit may no longer be your immediate supervisor, s/he can & will still sabotage you through the Smear Campaign to whomever will listen, new supervisor, company owner, other co-workers, etc. As long as there is a Great Counterfeit/Narcissistic Vampire in your mists you will never be safe or happy. You can hang in there and eventually one by one others will discover the true identity of the Great Counterfeit -- sometimes that works, but usually it doesn't. If you want to take a gamble with your career and happiness good luck with that! The other choice you have, like in the Family situation is to quit.

When new targets are identified and attacked, they will quickly remember what they saw when you held up the mirror. In fact, expect the call from them asking you to validate & confirm that the "second target" is not crazy by misinterpreting what they experienced. The second target may or may not go NC right away. It may take several more attacks from the Counterfeit to fully expose him/her for the evil Narcissistic Vampire s/he is. Since I was the first target to leave and it was after 40 years, then came my Aunt (Counterfeit Mom's second oldest friend of over 30 years), then Counterfeit Mom's longest friend of over 40 years. Were we the very first to see Counterfeit Mom's true evil Narcissistic Vampire nature -- no. Before we left, there was my maternal grandmother & aunt who "never seemed to get along" and I believe is on a NC status (at least my Aunt is while my grandmother is on extremely low almost NC). There are other relatives on Counterfeit Mom's side of the family that she "for some reason lost contact with". There are relatives from my Counterfeit Dad's side of the family that are in a NC status with her (yet, when I see them, they ask about her and tell me to send their love -- go figure -- until I told them about my NC status & they said they understood because "she was always so hard to get along with"). There were other long-term friends who one-by-one "took off for no reason" according to the Counterfeit Mom. From last I heard, Counterfeit Mom has ran out of friends and before her longest-known friends left she looked up an old colleague that she once worked with (hadn't talked to her for years), because she needed a place to stay & get her narcissistic supply from by playing the victim, which she does oh so well to the uninformed & unexperienced.

These Counterfeits are very smart and plan ahead. They know that other relationships are in trouble and instead of taking the time and doing the work to fix them (accept responsibility & take accountability for their part) they replace, substitute and move on. I have told my siblings that since I have decided to escape the KoN, I do not want to talk about Counterfeit Mom and I do not want her to know anything about my Life either. In fact the next time she hurts you I will be sorry for your pain, but unless you are ready to leave the KoN in which we were born into and escape the clutches of the evil Narcissistic Vampire I can not help you. I have given my siblings the tools to break the illusion of the Counterfeit Mom which is to stop making excuses for her evil behavior "her metal illness made her do it & her bad upbringing made her do it" and accept the painful truth that Evil is as Evil does.

It is our choice each day to love or to hurt. It is our Free Will. Nobody & no thing forces us to behave a certain way. Did you know these Counterfeits actually have the ability to control their evil behavior? Ever have the Counterfeit immediately stop raging to answer the phone, or door, or distract them by changing the subject and boast their Ego and the rage turns off like a switch. Maybe the Counterfeit wasn't raging against you, but s/he was cunningly verbally/emotionally abusing you with condescending slams and these stop immediately & instantaneously as soon as a new uninformed/unexperienced witness enters the room in which the Counterfeit's true identity has never been exposed to and at best is only a "rumor" from you. In fact, not only do these attacks stop instantaneously, the Counterfeit puts on his/her famous act of the "perfect" loving spouse/parent/family member/friend/co-worker/etc. On the other hand, the witness could be an enabling family member, co-worker, or friend who has "no clue" or slightly suspects the Counterfeit's true nature and identity, but is afraid to face the Truth that they not only do abusive evil things -- they are actually abusive & evil.

Don't worry that friends & family members do not believe the evil Narcissistic Vampires transformation back into the Great Counterfeit--you know it happens and that is all that matters. You are Not imagining things. We who have held up the mirror have witnessed the same thing. You are not alone. Just have patience and the Truth will eventually come out. The older the evil Narcissistic Vampires get the heavier the Mask of Deception is for them to carry and the mask will eventually drop. One by one, family members and friends will "discover" or realize the truth--at least that is what I am praying for! The only thing that matters now is that you protect yourself and your own Family of Creation/Choice by leaving the KoN.

Don't worry about those left behind. It is not your responsibility to save them, if they are adults. It is different if those left behind are Children. With adult Enablers you did not leave them behind -- they choose/chose to stay. The same Truth that set you free is there for them too, if they want to accept it. In fact it is much easier for those that follow your escape, because the trail has been blazed & they have a support system on the other side which You started. The reason why they stay is because there is some sort of pay-off either financially or emotionally or both. Perhaps, by you leaving there is a family dynamic change in where one sibling/family member was a target, along with you, and is now the desired Golden Child. I know this is one of the reasons one of my sibling stays, because from time to time the Counterfeit has come to his/her rescue. Another reason my siblings stay is, like with all abused children, the KoN has been their Normal, and they know no better. They don't know that a whole New World awaits them just beyond their Horizon.

They have only heard rumors of this Land of Love (LOL) but for some reason are afraid to leave what they know and adventure out into the great unknown. Perhaps they believe the Lie from Hell, that what they will find out of side of the KoN will be worse than what they leave behind, or the lie that a bad parent/grand parent/spouse/friend/etc. is better than none at all. In my Family of Origin (FOO) all these excuses are exacerbated by the fact that our Counterfeit Dad's true identity of preying on children was exposed, so we are all in NC with him which leaves us with only one Counterfeit Parent. To give up the remaining last Counterfeit Parent would make us orphans. Yes, this Truth is very painful, but it is survivable. I know that with God all things are possible and He has pulled me out of a pit of extreme depression more than once. I also believe that the love and power of God can replace Counterfeit Parents/Spouses/Siblings/Friends/Co-workers with truly Loving People who really have your best interest at heart.

Although we want the best for our families and desire to help them clean up the toxic mess, they don't see it that way. I'm hoping my motion to compel the trustee to do her duty comes to the top of the docket very soon, but since this sort of thing is apparently quite common, my understanding is that it could take up to 4 years, giving this "trustee" even more time to **** things up but, whether or not she has realized it yet, she can be held PERSONALLY LIABLE for losses the trust caused by her incompetence and negligence. Let's get it clear, this is not that. It is an attempt to share my own experiences using Nancy Lynne's own words in hopes that YOU will realize a benefit, even if it is only that of being able to see through her copious ability to charm and make things up as she goes along. I do not hate my sister, but I cannot accept her behavior any longer. Now, down to business.

Who said a man who is his own lawyer has a fool for his client? A greedy litigator, of course. I hope to show that it can be successfully accomplished, especially when the "trustee's" incompetence and abuse of power is so blatant as it has been here.

So far, in her capacity as the Trustee, Nancy Lynne has:

Cherry-picked the Trust document for language that suits her own desires.
Threatened to evict me and sell the home that Mom clearly wanted me to have, debt-free if possible.
Assumed that any resistance on my part would trigger the No Contest clause which she clearly pressured Mom to add.
Abused her new found power to retake money she's owed me for 30+ years.
Withheld crucial source documents.
Spent $17K that was never - to her surprise - part of the Trust's resources.
Refused to liquidate and distribute assets in a timely manner because I am so "pathetic and delusional."
Now that she can no longer deny misinterpreting the Trust document, she's decided that an old email should suffice in it's place.

On a validating and very encouraging note ...

Overheard in local legal circles about NANCY LYNNE: "Oh, HER? She married 2 GOOD guys and tried to take 'em for all they were worth!"

My case is still active, and I have to hope that if it were as foolish an endeavor to represent myself as the lawyers would have me believe, it would have been dismissed by now. If I could afford not to fight it, it would still be extremely satisfying to see Mom's wishes honored for once in her life. So, in addition to the above-listed fiduciary breaches, let us hope that the reputation of "The Nancy Lynne" does, indeed, precede her, not only with this trusteeship, but also with her seat on the Toledo City Council. She's been so habitually reckless with other people's money, I'm personally watching the news for missing City of Toledo funds.

It is obvious, and you have been perfectly aware all these years, that she NEVER intended to pay the mortgage for you, and that you had a verbal agreement to pay the mortgage on that property. Those are the intentions I intend to uphold on her behalf.

Relevant text from the JANICE C. EDDLEMAN REVOCABLE LIVING TRUST (emphasis mine):

"5.1 DESCENDANTS. At my death, my trustee shall distribute the residue of the trust estate in equal shares to my children. ..... I direct my trustee that the share of Brenda Haines shall, unless Brenda requests otherwise, include my real property in Seal Rock, Oregon, in kind if she survives me. A concern is that the Seal Rock property is subject to a secured debt, that the trust my not have sufficient value to allow for a debt free distribution of the property to Brenda Haines .... THEREFORE, my trustee is authorized to have the property appraised and to charge market value rent to be sure that Brenda Haines is able to accept this in kind distribution without losing the property, and to take any and all other reasonable steps to facilitate this distribution in kind."

Thankfully, Mom's concern that her estate would not have enough value has been negated by the equity in her house, which comps suggest is worth approximately $200K - plenty to split in equal shares and still cover Mom's direction that I receive my home debt free and in kind. However, nancy chooses not to see it this way, and my house is purportedly in danger of foreclosure if I don't bend to nancy's "will" and start paying her rent on my house which would be mine free and clear by now had nancy followed Mom's clear instructions. Nancy Lynne: What I Want my Sister to Know

My petition for summary judgement was bare bones K.I.S.S. and included only the Defendant Nancy Lynn's misconduct AS TRUSTEE.

1 nancy continues to blatantly ignore and to violate Oregon Revised Statutes and the Uniform Trust Codes governing her conduct.
2. nancy's actions indicate a tendency to exploit the elderly and disabled.
3. such conduct can now be rewarded with criminal felony charges.

HOW IN HELL DID SHE GET THIS POSITION? BY CLAWING FOR IT TOOTH AND NAIL starting in HER EARLY TEENS! Difficult to prove, but thankfully PRESUMABLE in our case. Mom was old and sick and frail, and nancy's iron will to have her own way despite the cost to her "loved ones" is in growing evidence.

The required "benefit to the advisor?" It's emotional as well as potentially financial, and may even be legal - luckily for nancy, she gained the ability to destroy evidence that might have been used against her were any semblance of a real investigation to ever take place, and I'm not suffering with CSI syndrome; I'm going by the guidelines, descriptions and promises made by the DHS website. FOR THE RECORD, nancy has consistently refused to comply with my right to see all source docs.

Her dismissive replies to my valid suggestions and numerous pleas causes my heart to break knowing what pressure Mom endured as nancy gradually pushed me away, even resorting to abducting my 5 year old son to terrify me into complying with nancy's "my way or the highway."

That nancy is NOW doing all she can to block my attempt to start another small biz does nothing to allay my suspicions that she INTENTIONALLY sabotaged me using a Sweetheart Scammer (they both worked at Gold Motors and were friends prior to my being set up "romantically" with him in the fall of 1999). This whirlwind event led to the loss of:
Brenda's good credit
Brenda's small business
Brenda's appetite/health
Brenda's ability to work (and, thereby, to keep purchasing her home)
"COINCIDENTALLY," it also led to Nancy's gain in the form of her own non-disabled yet rent/mortgage-free housing subsidy from Mom - but with payments made in her own name making her appear to be a credit-worthy, upstanding citizen when she's secretly a dastardly sneak and a cheat who, at least circumstantially, had a hand in the downfall of her sister which created this financial and emotional windfall for nancy herself. This was done under cover of "keeping things equal and fair," though it was largely nancy's behavior which contributes to my inability to work. I am not blaming her for everything that goes wrong as she might have you believe ... I am merely trying to get free of her, and if, by doing so, I can have her held accountable for her abuses to Mom and me, so much the better. I believe that this factor of trying to discredit me to keep me from exposing nancy's misdeeds toward Mom is part of the emotional and financial and legal benefit that nancy has wrongly claimed for herself as the "trustee."

Immediately upon receipt of the deed to my home, my SSI will increase to cover insurance, taxes, repairs, etc. related to home ownership, which will give me a steadier base of operations for business. In addition to her open contempt for her co-beneficiary, what should be clear by now that nancy was probably not selected for her particular skill in the arenas of finance, or fairness or diplomacy, and that Nancy Lynne is willing to coerce and manipulate and even terrorize, until now in secret, for what she wants, no matter to whom it rightfully belongs.

YOU CAN SEE THE ORIGINAL TRUST DOCS AT THE COURTHOUSE OR I WILL MEET YOUR FOR COFFEE AND SHOW THEM TO YOU. The "trustee" Nancy Lynne recklessly depletes the trusts resources by fighting for the right to cherry pick and twist language from the Trust doc in order to maintain the opportunity to exploit her disabled sister.

Nobody likes to be called on their BS, but a mature adult would, if only grudgingly and not exactly apologetically, finally comply with reason. It has been quite a setback to me to have to fight her for what Mom clearly wanted me to have and what would be an obvious shot in the arm for my efforts to work my way off of disability. I guess the Trustee would rather I stay disabled and she remain feeling entitled to act like a moron on a power trip, even at the risk of having the dark side of her narcissistic personality exposed IN COURT? I'm sorry, maybe a brain OR a heart would suffice, but she has neither: Did you SEE her advice about how only a professional, licensed electricial would be qualified to set up and plug in an electric ("plug n play") fence?

There are/were assets enough to split, but Nancy Lynne is quite fond of spending OPM with complete abandon, so I am hoping upon hope to hear good news from the Court before she is able to do even more serious damage. As the Trustee, she admitted to committing a non-existent $17K. DO YOU WRITE HOT CHECKS ON MONEY THAT YOU ONLY THINK IS IN YOUR ACCOUNT??? Better yet, her attempt to rectify this error amounts to trying to charge me 2x my monthly income to rent instead of selling Mom's place and using the proceeds to pay off all debts, including and especially this mortgage "in kind" as Mom wanted. So simple, yet Nancy has managed to complicate and confuse things that will take years to sort out. I'm just blogging here in an effort to let "the nancy lynne" know that I'm a people, not a golden goose.

Please do us all a favor and don't vote for her again. Seriously, folks, it's almost as if you can't possibly do any worse.

Defendant insists on employing the Trust in an erroneous context especially detrimental to the welfare of Plaintiff, a named co-beneficiary, by relying solely on what was clearly a contingency clause added to provide for the event which did not and cannot now occur without the Defendant herself being liable as the Trustee (Exhibit E - EXCERPT FROM TRUST DOC, Article 5; Exhibit F - EMAIL FROM DEFENDANT, July 25, 2011, pg 2, item 1; Exhibit G - TRUSTEE'S REPORT page 2, item 1).

Since the need for this provision was made obsolete by the value of the Estate at Settlor's death, Defendant had no grounds to rent out either house. Therefore, Defendant's efforts to collect payment from the Plaintiff should cease immediately in favor of Settlor's clear directive that the Defendant "take any and all reasonable steps that facilitate this distribution in kind." (Exhibit E - TRUST EXCERPT, page 2, last line of Article 5.1).

As supported by the Settlor's written wishes, Plaintiff urges the Court to compel the Defendant to fulfill her obligation as Trustee by placing the Fogarty Street house on the market at a price low enough to make it desirable, yet high enough to cover the "in kind" debt-free distribution of Plaintiff's home with an equal amount for the Defendant's share as ordered, and whatever other essential expenses must be paid by the Trust prior to making final disbursements and closing the Trust. Plaintiff concedes that the Fogarty Street house might have to be rented out to cover monthy expenses, but requests that the Court stipulate that this be an interim situation, abbreviated in cost and time to the utmost.

I was somewhat pleased that Mr. Pridgeon didn't shoot down my various reasons for this motion. On the other hand, we have Oregon law that states:

With all due respect, Mr. Pridgeon is not my attorney, he is the attorney for the estate and moreso, it appears that he has about as much knowledge of and respect for Oregon Revised Statutes as does the "trustee." Dear God my Mom could pick 'em! Thankfully the judge appears to know better, because this trust was supposed to be for my (and nancy's) benefit - and when it is finally disbursed according to Mom's wishes, I will get a small raise specifically for some badly needed home repairs, and maybe enough to help start my little goat biz. Better yet, I will have peace of mind knowing that a reckless, narcissistic imbicile is no longer in charge of something so crucial as my home! Justice delayed is justice denied. KNOW THE LAW, FOLKS! On the same day, defendant replied, refusing to comply with plaintiff's request. On or about February 10, 2011, in violation of ORS 130.655¹ UTC 802 and ORS § 130.660 UTC 803, defendant sent plaintiff a written accounting with demand purporting to require plaintiff to rent or purchase the Marsh Street home from the Trust or agree to it's sale. In violation of 130.715¹ UTC 814, defendant threatened to to use her "sole discretion" to enforce the in terrorem clause in the event plaintiff did not comply with the defendant's demand that she rent or buy or agree to the sale of her home. On February 15, 2011, plaintiff responded to defendant's written demand described above, whereby plaintiff urged the application in good faith of the underlying purpose of the Will and Trust documents: Page 4, Item 5.1 "to distribute in equal shares at my death." Also on February 15, 2011, defendant responded to above-mentioned request with this statement: "I will not be bullied by your ludicrous accusations and demands." Exhibit 4 attached.

On or about February 20, 2011 plaintiff diverted business startup funds to retain the legal services of Margaret Dailey to prevent defendant from effectively forcing her from the home that the trustor, Janice C. Eddleman clearly wanted her to have "in kind." A response from counsel for the estate, Jeff Pridgeon, assured that the property in question would not be sold, but that the Fogarty Street property instead would be appraised and sold. Exhibits 5 and 6 attached.

On May 2, 2011, plaintiff advised defendant of safety concerns with the electric circuit breakers at the Marsh Street house, which is still part of the estate. Defendant advised plaintiff, "it's 'your' house, you take care of it." Additionally, defendant gave more faulty advise to plaintiff regarding installation of an electric fence. Exhibit 7 attached.

On July 20, 2011, plaintiff received another indirect notification of the defendant's intent to charge the plaintiff "fair market value rent" on the Marsh Street property, erroneously relying upon a contingency in the Trust document and again violating ORS 130.715 UTC 802, 803, 804 and ORS.715 UTC 814. Exhibit 8 attached.

On July 21, plaintiff supplied proof of the source and amount of her fixed income of $449.34 per month and expressed wonderment that this important fact was apparently not considered in the compilation of the Trust instrument. Plaintiff pleaded that effectively forcing her (as well as the livestock needed for her new business) from her home was not of any benefit to her but would, in fact, be detrimental, even devastating. Plaintiff, relying on her experience as a professional home inspector, informed defendant that the Marsh Street home is in need of much deferred maintenance in order to be worth "fair market value" rent and reminded defendant that disbursement would entitle plaintiff to a 33% increase in her income specifically intended for insurance, repairs, maintenance and other such necessities. Exhibit 9 attached.

On July 23, 2011 plaintiff again urged the defendant to put the Fogarty Street property up for sale in an effort to maintain value and distribute as soon as possible.

On July 25, 2011, defendant reported to the plaintiff, with regards to the Fogarty Street property, the following: "The renovations have cost $17,500. If you've ever wondered how to get back at someone who's made your life a pure hell, you might consider making him or her the executor of your will.

Too often, people view being asked to serve as executor as something akin to being a godparent, a largely ceremonial position that is considered an honor. It is anything but, and estate-planning experts say most people who serve as an executor have no idea what they're getting into.

At the very least, it will involve 12 to 18 intensive months of tending to duties that require dealing with heirs, courts and the IRS. At its very worst, it could get you sued.

"I won't do it," says Howard Zaritsky, a former estate attorney and author of Tax Planning for Family Wealth Transfer.

Neither will many financial services professionals because money just brings out the worst in people. Families that have gotten along famously for years suddenly are at each other's throats over coffee tables and tea sets.

Zaritsky remembers a phone call he once got from a client. The FBI was at his door. Seems his brother was unhappy about something he took home from their parents' house and reported him for crossing state lines with stolen property.

Sherry McGillicuddy, executive vice president for Frost National Bank's financial management group, works as a trust officer and has served as an executor for many estates in her job. She has politely declined several requests from family members to serve as their executor.

"The pure liability of it scares the tar out of me as an individual," says McGillicuddy. "It's a lot of responsibility with lots of places you can make mistakes. You're considered a fiduciary. You can be sued personally if any family member doesn't like what you did. It jeopardizes my own children's inheritance of anything I might have."

Executing the job
If you have been asked, or are considering asking a friend or relative to take on the job, here are some of the tasks that will need to be performed:

Perform an inventory of the deceased's assets. This involves locating and making a record of everything the person owned, including investments. If there are antiques, artwork, collections or other valuables, appraisals will need to be obtained. "It doesn't mean you have to count the drawer full of socks," Zaritsky says, "but you have to say 'drawer full of socks.'"
Locate heirs. "This may be the family member no one has talked to or seen in 10 years," McGillicuddy says. "You may have to hire an investigator. You can't make distributions until you have them. If the will says, 'I leave this to all my living nieces and nephews,' you have to track them all down. It can be wonderfully fun at times, and sometimes it's extremely stressful."
Give notice of the death to institutions where the deceased had accounts. Some states may require putting a legal notice in the newspaper notifying creditors that they need to make a claim.
Petition the court to probate the will.
Safeguard the assets of the estate, which includes paying outstanding bills, managing any investments, making necessary repairs to keep the family house in good condition, keeping needed insurance in force and keeping the heirs from walking off with the personal property until probate is completed.
Prepare and file the federal estate income tax return, which is due nine months after the person died. File it late or screw it up and there can be penalties, for which the executor is personally responsible.
File their last tax return.
Distribute the remaining assets to the heirs as per the instructions in the will.
Possibly be responsible for arranging for the care of minor children, or handling their money for several years.

Of course, executors do get paid. The fee often is set by state law, but the industry standard is in the neighborhood of 3 percent of the value of the estate.

"Believe me, if you're dealing with a disputed estate, they're earning every penny," Zaritsky says. "And they earn the same amount whether it's disputed or not. No one gets paid enough if it's disputed. People yell and scream, they call you in the middle of the night and on the weekend. You never know someone until you divide an estate with them."

See the will first

If you're seriously considering taking on this responsibility -- and the experts are unanimous in their advice to hire a professional to do it unless you have a financial, legal and tax background and tons of time to devote to it -- you should do the one thing that hardly anyone does before saying yes. Ask to see the will.

"Well over 90 percent of my clients have not seen the document before the person died," says Jon Gallo, senior partner in estate planning for the law firm of Greenberg, Glusker, Fields, Clayman, Machtinger and Kinsella in Los Angeles. "Even more rarely have they seen a financial statement. They don't know what they're getting into."

Taking a look at the will gives you critical insights, such as whether the person plans to "disinherit" anyone (a lawsuit in the making), if he plans to donate everything to a charity (several lawsuits from unhappy heirs), or if there are substantial assets to manage, such as a business or investment property.

Zaritsky says that just asking to look at the will should tell you a lot about the person, who usually is thinking that by asking a friend or family member, they're going to save a lot of money.

"Say, 'Fine, let's sit down with your attorney and go over it,'" he says. "They'll understand what they're asking you to do, and they'll think, 'Oh hell, they're already spending my money.'"

It also will tell you if the estate is large enough for a bank's trust department to mess with it, or if you're going to get stuck doing it all yourself (after you hire an accountant to file the taxes and an attorney to handle the probate court filings). Some banks won't act as executor of small estates; McGillicuddy's bank charges a flat fee of $3,500 to serve as executor of an estate of less than $500,000. She recommends visiting two or three trust departments to see what they charge.

While you're there, make sure you ask to see their form letters, Zaritsky says. Most disputes relate to heirs who claim they weren't kept informed. Good form letters will take care of that.

If your heart is telling you to say yes, but your head is begging you to run in the other direction, agree to be a co-executor with a bank or a trust company. That way, the bank handles the legwork and you provide guidance on how the deceased would or wouldn't have liked his assets disbursed or his investments managed. For instance, a co-executor could nix an investment in a casino if he knew the deceased strongly opposed gambling.

When everything is said and done, it just makes more sense to tell Cousin Fred to hire a professional who has the right background, is adequately bonded (your state may require it), and can be sued if there's any negligence or funny business.

"People need to look at this as a business and a professional duty, not as an honor," McGillicuddy says. "When money is involved, people go nuts. I've seen the closest knit families get into rifts over small amounts of money. When it's large amounts of money, they just go crazy."

Sadly to say, this family has been anything BUT closely knit, and the trustee Nancy Lynne is in over her head. She apparently never deigned to read Oregon law governing her duties. Yesterday I filed a petition with the court for an in depth review of the situation in hopes she can be made to explain her outright disregard for Mom's wishes to the judge. I have also asked that she be held personally liable for spending $17,000 that wasn't actually in the account for her to spend, and for all attorney fees made necessary by her neglect to act with impartiality or prudence. With any luck at all, there will be a presumption of Nancy Lynne's undue influence over Mom and, maybe an investigation into criminal exploitation of the elderly and disabled.

A GOOD Example of Bully Trying to Isolate - Seeking Legal Forms

I knew there was something funky about the advice from the blonde lady from the probate department "to just write the Judge a letter." I have already spent my savings/biz startup funds to stop her from evicting me from the home that Mom clearly wanted me to have - I'm not spending my inheritance to get my inheritance. Thankfully, I have availed myself of some paralegal help in getting my case in from of the Judge. With any luck, the court will:

Compel the the trustee, Nancy Lynne, to comply with my request that she become bonded - if that is even possible now considering her mistakes AS TRUSTEE - and that the bond be charged to her equal share
Compel the trustee, Nancy Lynne, to put Mom's house up for sale immediately according to Mom's clear Plan A - meanwhile, since the estate is out of money thanks to yet another example of the trustee, Nancy Lynne's ineptitude and assumptive and entitled attitude - rent it out UNTIL THE FIRST ADEQUATE OFFER IS RECEIVED
Hold the trustee Nancy Lynne personally liable for the $17,000 owed to the contractor who renovated Mom's house - she thought it was hers to spend AS SHE WISHED, but it was disbursed by Hartford instead. OOPS!
Conduct a real investigation as outlined in the DHS manual describing exploitation of the elderly and disabled - presume undue influence - the trustee Nancy Lynne has expressed her contempt for me - in writing - without ever answering me about what I've done to offend her - besides being a willing whistle blower. Her iron will is evident in her emails, and there are many witnesses to Mom's chronically passive behavior.
In my wildest dreams! Hold the trustee Nancy Lynne personally liable for the $80,000 she's received as an indirect result of setting me up with a sweetheart scammer - put a constructive lien on the her house, which Mom also paid for, even though Nancy herself is not disabled.. Had she not done every thing she could to sabotage my business, my very life, she would never have been entitled to this monthly stipend. Coincidence? After considering everything else? I think not.

Holding the trustee, Nancy Lynne accountable for her egregious behavior toward me obviously does not equal "blaming her for every thing that's gone wrong win my life." She tells me constantly to "get over it," but I don't think that's what she really wants. The trustee Nancy Lynne's isolating behaviors CONTINUE as she tries to keep me from visiting with my friends from her class at their reunion. THIS IS HER PATTERN - SHE BULLIED ME SO BADLY WHILE GATEKEEPING MOM THAT I WASN'T ABLE TO HAVE A REAL RELATIONSHIP WITH MY OWN MOM SINCE ..... SINCE LITTLE NANCY LEARNED TO TALK. She grew big and mean and pushed me out of the nest ... out of the very family. I'm not going to let her keep me from seeing my friends tomorrow night, and if possible, I will pretend she doesn't even exist. It's so not about her - I will be there only to see many long lost school mates of my own.

I believe it is reasonable to conclude that the trustee Nancy Lynne bullied Mom into giving her this position, the same as the trustee Nancy Lynne has abused her powers to implement her own wishes instead of Mom's after her death - to my great detriment. I believe the trustee, Nancy Lynne, completely lacks the capacity for the loyalty, or even the impartiality, required by her fiduciary duty, but she wanted this job badly when she thought that "sole discretion" really meant that she could ignore the basic purpose of Mom's will/trust.

I am not expecting nor asking for immediate results; I am asking that the trustee Nancy Lynne to be held accountable and supervised in order to avoid any more costly mistakes. I pray that we make significant progress next week.

Go ahead and waste money on an appraisal. You will not succeed in collecting one penny in rent from me when the assets are/were there to effect an immediate distribution. If you CHOOSE NOT to implement Mom's Plan A by putting her house up for sale NOW in an attempt to distribute as soon as is humanly possible, I am prepared to petition the court to compel you to do so.

Mom's house on Fogarty has undergone some major renovation and will be ready to rent soon. It had to be gutted due to the extreme animal damage inside. There was sheetrock under the paneling which has now been repaired/replaced, taped, textured and painted. There was hardwood under the carpet which has now been refinished in the living room/dining area, and carpet and linoleum will be installed soon. Every room in the house has been renovated and/or refinished.

The advice I received from my Realtor, from Jeff Pridgeon, and from Mom's investment advisor are all consistent. The rental housing market in Newport is strong right now, and the sale market is at it's lowest point in years. So, the one clear choice on Mom's house is to rent it until the housing sale market improves to the point where it would make sense to sell it. I will not be putting it up for sale in order to fulfill your demands of having the Marsh Street property handed to you.
Why do I get the feeling that if I'd asked you to rent out Mom's house, you'd have chosen to sell it? That it might sell for more later doesn't mean that it wouldn't sell for enough now, and the housing market could easily continue to worsen. Therefore, I am extremely uncomfortable with you gambling with my future like that, especially if it's to prolong your duties and increase your own pay. Again, the "up to 10 years" idea was obviously supposed to be Plan B and wasn't even based in reality (you now have proof of my meager fixed income, but you should have had knowledge of it before you began requesting that I rent my own house for twice that amount) - yet you cling to Plan B when Plan A is possible. Is this just to show me that you can, again? Kinda like when you took Matthew, right?

The renovations have cost $17,500. There was plenty of cash in Mom's assets to handle the renovations and the upkeep, until I was told that the one largest investment account had been assigned to beneficiaries. So, rather than that $17,000+ going into Mom's estate account to be used for the renovations, it was split between you and me. The estate account is now out of money, due to this unforeseen development and the absence of the $17,000+.
So the estate will, at least, be able to finish paying the contractor?

I have been told by my contractor that the renovations are nearly finished. The yard needs some fairly major renovations too but they will have to wait. I hope to have the house rented starting September 1st and will be using a property management company to screen potential renters and to make sure everything is done correctly.
How much do you expect to be able to collect for rent on Mom's house after the renovations? Will you continue employing the property manager after the tenants are screened? Do you not trust yourself to learn the ins and outs of handling things yourself? Have you finally given up on the idea of renting out my home to me or anyone else? Will this plan B work without even more money that you erroneously counting on having?

The one thing you have not included in your supposed calculations of how this is all going to be split eventually is the equity in the Marsh Street house. So you can refigure your calculations and make sure you add that in under your 'plus' column. You will not be receiving the Marsh Street property title AND half of the value of Mom's house. Just to be perfectly clear on that.
As stated previously, I never expected more than my home free and clear plus - with any luck - a few thousand in cash. I don't know where you got any other idea.

I'm going to ask you one more time to stop your public slandering and defamation. As Jeff intended to inform you, everything I have done has been under his advice and is exactly what I'm supposed to be doing. If you don't believe me, call his office and make an appointment to go see him for 15 minutes.

Thankfully, Mom's concern is unfounded - the Trust DOES have sufficient value to allow for a debt-free transfer of this property as directed by the Trust, thereby negating the need to charge me FMV rent on the home my mother clearly intended for me to own debt-free.

" ... to take any and all reasonable steps that facilitate this distribution in kind."

This would appear to indicate, as Jeff himself concluded in his letter of March 9, that Mom's house needs to be sold ASAP, with the proceeds used to pay the balance of the Seal Rock mortgage with an equal remainder for Nancy Lynne as directed by the will and trust.

I have attached proof of my $449.34 monthly SSI income. PLEASE PRINT FOR YOUR RECORDS and refer to as needed. As I have stated previously, this amount will increase by a couple of hundred dollars per month when I receive the title to my home so that I can cover upkeep and repairs instead of charging them to Mom's estate.

I was at the courthouse today to receive instructions to petition the court to compel the Trustee to fulfill her fiduciary duty. I am in the process of doing just that, so let us dispense with the nonsense, please. Nancy says she wants nothing to do with me - let her prove it by liquidating the estate and distributing Mom's assets as Mom directed ASAP so that she and I can be done with one another forevermore.

SUMMARY of "Trustee" Nancy Lynne's to-date mistakes:

Nancy Lynne filed an erroneous Small Estate Affidavit with the Court.
Nancy Lynne expected the court to do her job of making sure I, as a co-beneficiary, received a copy of the Small Estate Affidavit.
By the first check she wrote from the Estate's account, indicated that her priority is Nancy Lynne Herself.
Nancy Lynne attempted to force me, her co-beneficiary, to buy/rent/agree to sell my home when there are enough assets in the Estate to assure a debt-free transfer of said home.
Nancy Lynne assumed that "a legal contest to the will" would require nothing more than my informally objecting to the arbitrary deadlines and false claims regarding Mom's wishes stated directly above - how could a City Councilor not know that a legal contest to a Will would require a formal lawsuit?
Abused her assumed powers to take, AGAIN, several hundred dollars that Nancy Lynne took from me more than 30 years ago by disregarding her fair share of rent and utilities.
Made another erroneous assumption about distribution of personal items and/or the amount they're sold for - and in her favor as a matter OF COURSE.
Was fully prepared to evict me from the home my mother clearly wanted me to have, and with a crisp One Dollar Bill in exchange - even though the Estate DOES possess adequate value to cover distribution according to Mom's wishes (AND with enough to ensure that Nancy Lynne gets an equivalent share).

It appears to me that, despite glib appearances, Nancy Lynne is not all that confident in her own ability to retain her current employment and for good reason. Her first Trustee's report is especially interesting when compared with this description of criminal undue influence and exploitation of elders. True to form, Nancy Lynne has refused to comply with her fiduciary duty to provide a corrected version. I am grateful that she is being supervised by the attorney for Mom's Estate. However, this situation has taken so much out of me that I will have to delay starting my new business until, hopefully, next year.

FOR THE RECORD: I do not expose my sister's unethical behavior for the pleasure of doing so - there is no pleasure in it. However, since Nancy Lynne is willing to repeatedly cheat members of her own FAMILY, whatever is to stop her from acting unethically toward her mere CONSTITUENTS? (hint: YOU!)
